The case is still open, and apparently now she could be charged (even though it's been reduced to misdemeanor level based on how the accident played out). In case you're wondering what the California law is on that, it has a maximum of 1 year sentence (but with a good lawyer, I suppose it could get pleaded down to community service or possibly an ankle braclet for house arrest). I hope for her sake (since she hasn't officially had the surgery) that she doesn't end up in jail.
